The lawsuit alleges that Allen Properties violated the California Labor Code by failing to provide employees with timely, off-duty meal and rest periods.

LOS ANGELES, May 10, 2022 /PRNewswire-PRWeb/ — The Los Angeles labor lawyers, Zakay Legal Group, APLC and Law Firm JCL, APC, filed a class action lawsuit against PFC Enterprises, Inc. DBA Allen Properties (“Allen Properties”) for allegedly failing to provide employees with timely meal and rest periods outside of working hours. The Allen Properties class action lawsuit, Case No. CIVSB2207363, is currently pending in the San Bernardino County Superior Court of state of california. A copy of the complaint can be read here.

According to the lawsuit, Allen Properties violated California Labor Code Sections 201, 202, 203, 204, 221, 226, 226.7, 246, 510, 512, 1194, 1197, 1197.1, 1198, and 2802 by failing to: ( 1) pay overtime wages; (2) pay the minimum wage; (3) provide the required information meal and rest periods; (4) provide accurate and detailed salary statements; (5) pay wages when due; and (6) reimburse employees for necessary expenses.

The lawsuit also alleges that Allen Properties violated the Private Attorneys General Act (“PAGA”), which gives rise to civil penalties due to the conduct of Allen Properties. PAGA allows aggrieved employees to take legal action to recover civil penalties on behalf of themselves, other employees and the state of california for violations of the labor code. An “aggrieved employee” is defined as “any person who was employed by the alleged infringer and against whom one or more of the alleged violations were committed”. Cal. Laboratory. The Margaret Kistow Children’s Home says it has sought a legal opinion regarding the findings of the Judith Jones Committee report on child abuse.

Home officials said a libel suit would be filed as they called the statements published in the report libelous and “incendiary untruths”.

The report, titled “The Protection of Children in Community Residences and Child Support Centers in Trinidad and Tobago,” was tabled in parliament last Friday. It detailed findings of physical and sexual abuse of children, among other problems in children’s homes, rehabilitation centers and other institutions that provide care for children.

Among the report’s findings regarding the home, several boys were living in the private residence of a home manager, hiring an employee who had previously been the subject of sexual abuse allegations, and sending of children spending weekends with people. who are not their legal guardians.

The report recommended that the home be immediately shut down and investigated.

The Sunday Express has made several attempts to contact the home over the past week, by phone and email, for a response to the findings published in the report.

Several attempts had been made to contact the home via the email address and phone number listed on its Facebook page.

Maintenance canceled

Director Xerxes Seales invited this reporter to visit the house on Thursday to conduct an interview with Kistow. This was later overturned, as Seales said the house had received legal advice, advising that questions be sent in writing to minimize the possibility of being misquoted.

Questions were sent, asking the home to respond to the specific findings of the report.

Seales acknowledged receipt and assured that Kistow was reviewing the questions and would respond “as soon as possible.”

No responses to questions were received.

In other telephone exchanges with Seales, he expressed concern about media reports regarding the Judith Jones committee report and said the home had not been given the opportunity to respond.

He said his lawyers had advised the home not to give detailed statements to the media because they could be misinterpreted. Seales said the house had nothing to hide and was following the advice of its legal team.

He said Kistow intended to take legal action, but did not specify against whom.

The Judith Jones committee report has been the subject of much discussion over the past week. Gender and Children’s Minister Ayanna Webster-Roy told the Express last week that the home continued to operate despite the recommendation that it be closed immediately, as “there is a process in place to remove licenses from residences communities by the CATT (Children’s Authority).

The house, however, is unlicensed, as noted in the Judith Jones committee report.

Webster-Roy announced last week the creation of a task force to develop a plan to implement the recommendations contained in the Judith Jones committee report.

Webster-Roy told this reporter that all of the recommendations made in the report are being reviewed by the task force and will be included in the work plan which will be finalized and submitted to Cabinet in six weeks.

“Where there are recommendations that the task force believes needs to be expedited, an appropriate recommendation will be made to do so,” she said.

The Grand Rapids police officer who shot and killed Patrick Lyoya after a traffic stop earlier this month has been repeatedly praised by senior police officers for similar traffic stops in recent years.

Some of the letters of recognition from then-police chief David Rahinsky explain the reasons for the arrests.

In September 2016, Rahinsky wrote, Schurr stopped a car when it “immediately stopped in the driveway” after seeing him. Police found a “bag of marijuana” on the driver and a loaded gun under the driver’s seat. The driver was arrested on five counts, according to the letter.

In June 2016, according to another acknowledgment letter, Schurr followed a vehicle that “quickly changed direction as it passed [him.]Schurr spoke with the driver, who “admitted to selling cocaine with the two passengers.” The driver and passengers were arrested.

“It is with great pride that I thank and congratulate you on your outstanding discharge of duty,” Rahinsky wrote.

According to another letter in Schurr’s file, none of the more than 2,000 traffic stops initiated by his team in 2016 resulted in a citizen complaint of excessive force or discourtesy.

But those traffic stops, and others described in Schurr’s file, reflect much of what happened the morning of April 4, when police officials said Schurr had arrested Patrick Lyoya for driving with a license plate that did not match the car.

When Lyoya tried to flee, Schurr chased after him. The two men struggled for control of Schurr’s Taser, and the struggle ended when Schurr shot Lyoya while pinning him to the ground.

Traffic stops for minor violations have drawn the attention of civil rights activists, who argue they are alarmingly likely to escalate into deadly encounters with police, especially for black drivers. Some cities eliminate or limit these stops.

And in Grand Rapids, after Lyoya’s death, activists told police they weren’t surprised at the outcome of the traffic stop, saying the department’s tactics led directly to the shooting. “We told you exactly what was going to happen, and you didn’t believe us. You should all be ashamed,” said one.

At the April 13 press conference where the Grand Rapids Police Department released videos showing what happened when Schurr arrested Lyoya, current GRPD Police Chief Eric Winstrom said that he was a “reformer”. The department spokesperson said Friday that the GRPD “has no additional comment” on the contents of Schurr’s personnel file.

Ven Johnson, attorney for the Lyoya family, also declined to comment.

The Grand Rapids Police Officer’s Association – the union representing the city’s police – said in a Facebook post earlier this week that he “stands with Officer Schurr” and defended his actions.

“The police are trained in the fact that a simple traffic check can quickly become dangerous or fatal for the police officer or innocent passers-by,” the association said.

“A subject of police contact may have a history of violence, sometimes even several violent episodes, and may attempt to harm the police officer or the public.”

“As tragic as this case is, we believe that a thorough examination of this entire situation will show that a police officer has the legal right to protect themselves and their community in a dangerous and volatile situation such as this,” said the message.

Packard’s abandoned factory saga took an unexpected turn when its owner, Peruvian businessman Fernando Palazuelo, missed a court-set deadline to file the required demolition permits in April 2022. The city could having to take charge of the demolition of the installation.

Palazuelo was ordered to begin demolishing the plant by mid-May by a Detroit court on March 31, 2022 and a local news channel Click Detroit reported that he had until April 21 to obtain the required permits. City officials confirmed to the outlet that that deadline had passed and it was unclear what would happen next. Detroit is considering demolishing the plant itself and billing Palazuelo for the work.

Largely vacant for decades, the Packard factory has the sad honor of being one of the largest industrial ruins in the world. Dismantling it is considerably more difficult and much more expensive than it looks: the Detroit Free Press estimates demolition will cost at least $10 million. As we previously reported, collecting this debt from Palazuelo may become a significant challenge for city officials.

It seems that somehow the days of the Packard factory are numbered – the bridge that crosses East Grand Boulevard collapsed in 2020 and the facility was declared a public nuisance by the judge of the Wayne County Circuit, Brian Sullivan. Neighbors said Click Detroit that they fear children breaking into property and hurting themselves during the day, and that they fear for their own safety at night.

Palazuelo has not commented on the report, so we don’t know why he didn’t file the required permits on time. However, he has previously criticized city officials for failing to support his ambitious development plans, which included residential, commercial, industrial and artistic spaces. He even planned to build a go-kart track on the site. He also claims to have invested approximately $7 million in the property since it was purchased for $405,000 at the 2013 Wayne County tax auction; in particular, he set up security around the site and began asbestos removal.

Bamia 2 LLC reportedly failed to accurately record employee time, resulting in inaccurate minimum wages and overtime.

CONTEXT

Prince George, BC – Prince George RCMP are asking for the public’s help in locating a suspect after a woman was sexually assaulted over the weekend.

Just after noon on Sunday March 27, 2022, Prince George RCMP received a report of a sexual assault that occurred at a housing complex in the 2600 block of Recplace Drive earlier in the morning.

The victim was holding an open house at the scene and showing the unit to the male suspect. The woman reports that the man came up behind her and touched her back before groping her. When the woman screamed, the man left the scene on foot.

The suspect is described as:

At the time of the incident, he was wearing transitional glasses, a dark blue hoodie, baseball cap and light blue jeans with rips at the knees.

The victim suffered no physical injuries during the incident.

The police are conducting an extensive CCTV campaign in the area. No other similar incident has been reported.

“The sexual assault happened in the middle of the day in a busy part of town. We want the public to be aware of what happened and remain vigilant when dealing with strangers on a one-to-one basis. Additionally, we are looking to speak to anyone with CCTV or a dash cam capturing the suspect leaving the scene at approximately 11:15 a.m.,” Cpl says.
