According to the lawsuit filed, Bamia 2 LLC allegedly (a) failed to pay minimum wage, (b) failed to pay overtime, (c) failed to provide legally required meal and rest periods, (d) failed to provide accurate itemized wage statements, (e) failed to reimburse employees for required expenses, and (f) failed to provide wages when due, all in violation of applicable Labor Code Articles listed in California Labor Code Sections §§ 201, 202, 203, 226, 226.7, 510, 512, 1194, 1197, 1197.1, 2802, and applicable wage ordinance(s), and thereby gives rise to civil penalties as a result of such alleged conduct.

Bamia 2 LLC allegedly failed to pay the employees the entire time they were under the control of the employer. This would include the time the plaintiff and other members of the California group had to undergo mandatory COVID-19 testing before clocking in for the day. To the extent that time worked off the clock was not eligible for payment of overtime premium, the defendant allegedly failed to pay the minimum and overtime pay for the time worked in off-peak hours.
