According to the lawsuit filed, Panda Express, LLC allegedly (a) failed to pay minimum wage, (b) failed to pay overtime pay(c) failed to provide legally required meal and rest periods, (d) failed to provide accurate itemized wage statements, (e) failed to reimburse employees for required expenses, and ( f) failed to provide pay when due, all in violation of applicable sections of the Labor Code listed in Sections 201, 202, 203, 226, 226.7, 510, 512, 1194, 1197, 1197.1, 2802 of the California Labor Code and applicable wage ordinances, and thus gives rise to civil penalties as a result of such alleged conduct.
Additionally, Panda Express, LLC allegedly failed to reimburse employees for required business expenses. California Labor Code § 2802 expressly states that “The employer shall indemnify his employee for all necessary expenses or losses incurred by the employee as a direct result of the performance of his duties…” During employment, the plaintiff and others California class members would have been required to use their personal cell phones and personal home offices to perform their duties, with no reimbursement for the use thereof.
