The California Supreme Court defines off-duty rest periods as the time an employee is relieved of all work-related duties and free from the control of the employer.
PAGA is a mechanism by which the State of california itself can enforce state labor laws through the employee suing under the PAGA who does so as an agent or agent of the labor law enforcement agencies of the State. A civil penalty recovery action under the PAGA is fundamentally a law enforcement action designed to protect the public and not for the benefit of private parties. The aim of PAGA is not to recover damages or restitution, but to create a way to “delegate” citizens as private attorneys general to enforce the Labor Code.
