The complaint alleges that Renoir HM, LLC did not pay the employees while they were under the control of the defendant. This, allegedly, includes the time the plaintiff and other aggrieved employees had to go through mandatory temperature checks and symptom questionnaires for COVID-19 testing before checking in for the day. Since the time worked outside the clock was not eligible for payment of the overtime premium, the defendant allegedly failed to pay the minimum wage for the time worked outside the clock.

PAGA is a mechanism by which the State of california itself may enforce state labor laws through the employee suing under the PAGA who does so as an agent or agent of the labor law enforcement agencies of the State.
