According to the complaint filed, TForce Freight, Inc. allegedly (a) failed to pay minimum wage, (b) failed to pay overtime, (c) failed to provide legally required meal and rest periods, (d) failed to provide accurate information, detailed pay statements, and (e) failed to reimburse employees for required expenses, all in violation of the applicable sections of the Labor Code listed in the sections of the California Labor Code § § 226, 226.7, 510, 512, 1194, 1197, 1197.1, 2802 and the applicable salary order (s), and thus give rise to civil penalties as a result of such alleged conduct.

TForce Freight, Inc. allegedly failed to reimburse employees for required business expenses. The California Labor Code § 2802 expressly states that “an employer shall compensate its employee for all necessary expenses or losses incurred by the employee as a direct result of the performance of his duties …” During employment, the applicant and other California class Members would have been required to use their personal cell phones to perform their duties.
