Los Angeles Employment Lawyers at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action lawsuit alleging that Monroe Operations, LLC violated the California Labor Code. The Monroe Operations, LLC class action lawsuit, Case No. 30-2022-01268754-CU-OE-CXC, is currently pending in the Superior Court of Orange County in the State of California. A copy of the complaint can be read here.
The complaint alleges that Monroe Operations, LLC failed to pay the employees during the entire time they were under the control of the employer. This would include the time the applicant and other members of the California group had to submit to mandatory COVID-19 questionnaires and temperature checks before clocking in for the day. To the extent that time worked off the clock was not eligible for payment of overtime premium, the defendant allegedly failed to pay the minimum and over time pay for time worked outside of clock hours.
Additionally, the lawsuit alleges that the defendant underpaid minimum wages and overtime to the plaintiff and other members of the California class by not paying those wages at the regular rate of pay. The plaintiff received a non-discretionary bonus that was allegedly not calculated in the normal rate of pay, resulting in alleged underpayment of minimum wage and overtime.
